In accordance with Article 435 of the Civil Code of the Russian Federation, this document is an offer. The agreement is concluded by acceptance by the person who responded to the offer (hereinafter referred to as the &quot;Buyer&quot;). The written form of the agreement is considered to be observed by virtue of Article 434 of the Civil Code of the Russian Federation. S. Sh. Lorsanova, 3, apt. 12.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">1.2. Contact information: info@bizzz.media, tel.: +7 925 995-04-07 (working hours 10:00\u201318:00, GMT+4). <\/span><\/p><p><span style=\"font-weight: 400;\">1.3. Terms<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78e43c8 elementor-widget elementor-widget-text-editor\" data-id=\"78e43c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>2.1. Product \u2014 any of the electronic Audio Tours compiled by the Seller offered for sale on the Site.<\/p><p><span style=\"font-weight: 400;\">2.2. An audio tour is a collection of audio files, images and texts containing tour information, provided in digital form.<\/span><\/p><p><span style=\"font-weight: 400;\">2.3. Site \u2014 a site on the telecommunications network &quot;Internet&quot; <a href=\"https:\/\/bizzz.media\/en\/\">https:\/\/bizzz.media\/<\/a>, on which the Goods are offered for sale.<\/span><\/p><p><span style=\"font-weight: 400;\">2.4. Bot \u2014 a Telegram bot through which access to content is provided.<\/span><\/p><p><span style=\"font-weight: 400;\">2.5. Buyer (User) \u2013 a legally capable individual purchasing an Audio Tour for personal use.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-3a03175 e-con-full e-flex e-con e-child\" data-id=\"3a03175\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-c12cd30 elementor-widget elementor-widget-heading\" data-id=\"c12cd30\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">3. Subject of the agreement<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f05f3c1 elementor-widget elementor-widget-text-editor\" data-id=\"f05f3c1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">3.1. Under this Agreement, the Seller undertakes, in the manner and under the conditions stipulated by this Agreement, to provide the Buyer, for a fee, with a non-exclusive license to use the Audio Tour for personal purposes from among those compiled by the Seller and offered for sale on the website.<\/span><\/p><p>3.2. Each Audio Tour offered for sale is an independent product and an independent object of copyright. By purchasing access to one Audio Tour, the Buyer does not purchase access to other Audio Tours available on the Site; such access must be purchased separately.<\/p><p>3.3. The product is an object of intellectual property created by the creative work of the Seller.<br \/>By providing the Buyer with access to the Audio Tour, the Seller does not alienate, does not grant a full license, does not transfer to the Buyer in any other way its intellectual rights in relation to it in whole or in part.<\/p><p><span style=\"font-weight: 400;\">3.4. Access to the Audio Tour is provided through the Bot after payment confirmation. <\/span><\/p><p><span style=\"font-weight: 400;\">3.5. The geography of use is not limited.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-891ce97 e-con-full e-flex e-con e-child\" data-id=\"891ce97\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-29ef96a elementor-widget elementor-widget-heading\" data-id=\"29ef96a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">4. Conclusion of the contract<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-86c5544 elementor-widget elementor-widget-text-editor\" data-id=\"86c5544\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">4.1. The publication of this offer is an offer from the Seller addressed to an indefinite number of persons.<\/span><\/p><p><span style=\"font-weight: 400;\">4.2. The order of the Goods is made on the website\u00a0<a href=\"https:\/\/bizzz.media\/en\/\">https:\/\/bizzz.media\/<\/a>\u00a0by the Buyer filling out the appropriate form.<\/span><\/p><p><span style=\"font-weight: 400;\">4.3. The Agreement is considered concluded from the moment payment is received in the Seller\u2019s bank account.<\/span><\/p><p>4.4. Placing an order is available to an unlimited number of Site users. As a result of placing an order and purchasing the Product, the Buyer will be registered on the site to gain access <a href=\"https:\/\/starbizzz.xl.ru\/\">https:\/\/starbizzz.xl.ru\/<\/a>, to which the Buyer, by placing an order and paying for the Goods, gives his consent.<br \/>A personal account will be created for the Buyer on the website specified above, the login and password for access to which will be provided by e-mail specified when placing the order.<\/p><p>4.5. The Buyer is responsible for the content and accuracy of the information provided when placing an order. If the Buyer provides false information, the Seller shall not be liable for any adverse consequences that may arise, including, but not limited to, the inability to provide the Buyer with access to the purchased Goods.<br \/>If incorrect contact information is provided and the Seller cannot contact the Buyer within two days from the date of placing the order, the order is considered cancelled.<\/p><p>4.6. If the Buyer mistakenly indicated an incorrect email address when placing an order, the Buyer shall send a corresponding message to the Seller&#039;s contact email address. <a href=\"mailto:info@bizzz.media\"><span style=\"font-weight: 400;\">info@bizzz.media<\/span><\/a> for the Seller to send instructions on how to gain access to the Product.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2b9cad0 e-con-full e-flex e-con e-child\" data-id=\"2b9cad0\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-350e013 elementor-widget elementor-widget-heading\" data-id=\"350e013\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">5. Price and payment procedure<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48cceaa elementor-widget elementor-widget-text-editor\" data-id=\"48cceaa\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">5.1. The current price of each Audio Tour is indicated on the relevant page of the Site and includes all applicable taxes, unless otherwise stated. <\/span><\/p><p><span style=\"font-weight: 400;\">5.2. The payment for the order is made by the Buyer in full immediately upon its placement, by making a non-cash payment through the Prodamus service and the form contained on the Site, and completes the placement of the order.<\/span><\/p><p><span style=\"font-weight: 400;\">5.3. Payments are made in the currency selected by the Buyer from the list offered by the payment service (RUB, GEL, USD, EUR, etc.). Payment system fees are included in the price, unless otherwise expressly stated.<\/span><\/p><p>5.4. The Seller is not the owner of the payment system integrated into the Site, and therefore is not responsible for its incorrect functioning, except in cases where the malfunction was caused by incorrect integration of the system with the Site by the Seller.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-b1e7649 e-con-full e-flex e-con e-child\" data-id=\"b1e7649\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6520de4 elementor-widget elementor-widget-heading\" data-id=\"6520de4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">6. License rights and restrictions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9ceef69 elementor-widget elementor-widget-text-editor\" data-id=\"9ceef69\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">6.1. The Buyer is granted a non-exclusive, non-transferable right to listen to the Audio Tour and view related materials solely for personal, non-commercial purposes. <\/span><\/p><p><span style=\"font-weight: 400;\">6.2. It is prohibited to copy, transfer to third parties, publish on the Internet, reproduce publicly or otherwise distribute the Audio Tour without the written consent of the Seller. <\/span><\/p><p><span style=\"font-weight: 400;\">6.3. A one-time payment provides access to only one User.<\/span><\/p><p>6.4. In case of violation of clause 6.2 of this Agreement, the Buyer undertakes to pay the Seller a fine in the amount of 1,000,000 (one million) rubles.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-a791eeb e-con-full e-flex e-con e-child\" data-id=\"a791eeb\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-13bc4a5 elementor-widget elementor-widget-heading\" data-id=\"13bc4a5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">7. Procedure for granting access<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2cf13d3 elementor-widget elementor-widget-text-editor\" data-id=\"2cf13d3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">7.1 After payment confirmation\u00a0<\/span>The Seller, no later than 24 hours after the Buyer places an order and makes payment, sends the Buyer a link to access the Bot and instructions on how to gain access to the Product to the email address specified when placing the order.<\/p><p>7.2. If the Seller duly fulfills the obligation to send information about access to the Bot, and the Buyer does not send the Seller a message about the impossibility of reviewing the Product within 10 (ten) days from the moment the information was sent, access to the Product is considered to have been properly provided regardless of whether the Buyer took advantage of the opportunity to review the Product.<\/p><p>7.3. Access is provided for a period of 1 (one) year from the moment the Buyer receives a link to the Bot and instructions on how to gain access to view the purchased Product.<\/p><p><span style=\"font-weight: 400;\">7.4. After completing the Audio Tour, audio files, images and texts remain in the Buyer&#039;s correspondence with the Bot indefinitely. The Seller is not responsible for any possible failures in the operation of the Telegram messenger or restrictions on access to it. In case of technical difficulties, the Buyer has the right to contact the Seller&#039;s support service (info@bizzz.media).<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2ea5f02 e-con-full e-flex e-con e-child\" data-id=\"2ea5f02\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-fd3b65f elementor-widget elementor-widget-heading\" data-id=\"fd3b65f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">8. Right of refusal (return)<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-acb6aaf elementor-widget elementor-widget-text-editor\" data-id=\"acb6aaf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">8.1. Before the Buyer clicks the \u201cStart Tour\u201d button in the Bot, he\/she has the right to cancel the contract within 14 (fourteen) calendar days from the date of payment and request a refund by sending a written statement to info@bizzz.media. <\/span><\/p><p><span style=\"font-weight: 400;\">8.2. When refunding funds, non-refundable fees of payment services and banks in the amount of 20% from the payment amount are withheld. <\/span><\/p><p><span style=\"font-weight: 400;\">8.3. After the start of the excursion (pressing the \u201cStart excursion\u201d button in the Bot), the right to withdraw from the contract and return funds is lost.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2dff36f e-con-full e-flex e-con e-child\" data-id=\"2dff36f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7daa17f elementor-widget elementor-widget-heading\" data-id=\"7daa17f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">9. Processing of personal data<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0e819cb elementor-widget elementor-widget-text-editor\" data-id=\"0e819cb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">9.1 Personal data is processed in accordance with the Privacy Policy located at <a href=\"https:\/\/bizzz.media\/en\/policy\/\">https:\/\/bizzz.media\/policy<\/a>.<\/span><\/p><p><span style=\"font-weight: 400;\">9.2. Purposes of processing: conclusion and execution of this agreement; accounting and tax accounting; technical and information support for the Buyer; marketing mailings, subject to consent.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-ffcfab1 e-con-full e-flex e-con e-child\" data-id=\"ffcfab1\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-6978b93 elementor-widget elementor-widget-heading\" data-id=\"6978b93\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">10. Rights and obligations of the parties<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-58f13b9 elementor-widget elementor-widget-text-editor\" data-id=\"58f13b9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">10.1 The Buyer undertakes to:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">pay the cost of the selected Audio Tour in full and on time; <\/span><\/li>\n<li><span style=\"font-weight: 400;\">use the Audio Tour solely within the limits of the license granted;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">not disclose access information to the Bot to third parties;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">in case of any claims or technical problems, immediately notify the Seller.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">10.2. The Seller undertakes to:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">provide the Buyer with access to the purchased Audio Tour within 24 hours after receiving payment;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">upon receipt of requests from the Buyer, provide information support within 72 hours on business days;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">process the Buyer&#039;s personal data in strict accordance with current legislation and its own Privacy Policy.<\/span><\/li>\n<\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9a0ae0c e-con-full e-flex e-con e-child\" data-id=\"9a0ae0c\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-ec0f72a elementor-widget elementor-widget-heading\" data-id=\"ec0f72a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">11. Responsibilities of the parties<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2da182b elementor-widget elementor-widget-text-editor\" data-id=\"2da182b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">11.1 The Parties shall be liable in accordance with the applicable legislation of Georgia and the Russian Federation. <\/span><\/p><p><span style=\"font-weight: 400;\">11.2. The Seller shall not be liable for:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">impossibility of using the Audio Tour for reasons dependent on the Buyer\u2019s equipment or software, as well as on the operation of the Telegram messenger and payment services;<\/span><\/li><li><span style=\"font-weight: 400;\"> consequences of unauthorized use of the Audio Tour by third parties, arising through the fault of the Buyer.<\/span><\/li><\/ul><p>11.3.
